General Terms and Conditions of Sale – Basar Valira

These Conditions regulate the purchase of products through the Basar Valira website. Placing an order implies acceptance of these Conditions, without prejudice to the mandatory rights corresponding to the consumer under applicable regulations.

0. Safeguard of rights

Nothing stated in these Conditions limits or excludes the mandatory consumer rights that are applicable, nor the liabilities that by law cannot be limited.

1. Identification of the Shop

BASAR VALIRA, is the owner of the web portal www.basarvalira.com, acting exclusively as operator and manager of the web portal contents, domiciled at: Carrer del Picó, 1-3, AD700 Escaldes-Engordany, NRT: E-005131-Y, Registered in the Commercial Registry No.: 902436H. Contact: info@basarvalira.com.

2. Scope of application and minimum age

These conditions apply to sales made to consumer customers through this website. To contract, the Customer must be at least 18 years old and have sufficient legal capacity.

3. Purchase process and contract formation

The purchase process consists of the following steps:

  • a) Order request (purchase offer): by clicking on “Finish Purchase”, the Customer sends an order request to the Shop.
  • b) Acknowledgment of receipt: the Shop will send an automatic email confirming the receipt of the order. This email does not constitute acceptance of the contract; it is a voucher stating that the request is in the process of technical and stock validation.
  • c) Validation and confirmation: the sales contract will be deemed formalized when Basar Valira sends the “Shipping/Dispatch Confirmation” email, after physically verifying the availability of the product and the validity of the payment.
Checkout notice (recommended)

“We handle unique collection units. Final availability confirmed after manual validation (24–48 h). In case of exhaustion due to simultaneous sale, full refund without undue delay.”

4. Availability and indicative stock (24–48 h validation)

Given the coexistence of physical and online sales, the stock shown may be indicative. In the case of collection items, last units, or limited editions, the physical verification of availability may require up to 48 business hours. In case of unavailability, the Shop will proceed to cancel the order and issue a full refund by the same means of payment without undue delay. Basar Valira shall not be liable for indirect damages or loss of profit derived from lack of availability.

5. Prices and import taxes (customs)

  • a) Deliveries in Andorra: prices include the applicable indirect tax in Andorra (IGI) where appropriate.
  • b) Deliveries outside Andorra (e.g., EU): prices may be shown exempt from Andorran taxes. The Customer acknowledges that the shipment may be subject at destination to import VAT, duties, and/or carrier management fees.

Commercial gesture (optional): Basar Valira may, after verification and agreement, assume or partially/totally compensate certain charges.

6. Delivery and transmission of risk

Delivery times are estimates. Basar Valira commits to deliver orders within a maximum of 30 days. The risk of loss or damage is transferred to the Customer at the time of effective delivery.

7. Payment methods and security

Payment shall be made through the authorized methods in the Payment Policy. Security is managed via SSL/TLS encryption.

8. Withdrawal and returns

The Customer has a period of 14 calendar days to withdraw from the purchase. Specific conditions and procedures are detailed in the Returns Policy.

9. Legal guarantee of conformity

A legal guarantee of conformity applies according to applicable regulations, with a minimum of 2 years.

9.1 Technical evaluation of Radio Control (RC) products and Batteries:

A radio control product, whether misused or not by the customer, will be evaluated by our technical service to determine the origin of the incident. The Customer is informed that rechargeable batteries have no warranty as their delicate handling under utilization, whether in full use or charging, can be dangerous. In the remote case of damage caused by batteries such as fire, burns, or any other incident, BASAR VALIRA is not liable.

10. Governing law and dispute resolution (ADR)

This contract is governed by the laws of the Principality of Andorra, without prejudice to the mandatory consumer rights in their country of residence.

11. Complementary policies

These Conditions are integrated with the Shipping, Payment, Returns, and Website Use Policies.
